FR application filed seeking withdrawal from UNHRC resolution

A Fundamental Rights application was filed in Sri Lanka's Supreme Court, seeking the government to withdraw from the UN Human Rights Council (UNHRC) resolution 30/1 that it co-sponsored in 2015.

The application was filed by the Truth Seekers Movement, who claim that by co-sponsoring resolution 30/1, Sri Lanka has allowed for several activities to take place which are inconsistent with the Constitution.

Resolution 30/1 which was co-sponsored in 2015 under Sirisena's administration, mandates foreign judges to participate in an accountability mechanism to examine the crimes committed at the end of the armed conflict.

The Petitioner states adding that as long as this remains in force the Petitioner and every citizen of Sri Lanka would be subject to the jurisdiction of a foreign judicial mechanism.

The Petitioner wants the Supreme Court to declare that by co-sponsoring this resolution, the Constitution and the sovereignty of the people of Sri Lanka has been violated. Therefore, the state should take measures to withdraw from the resolution.
